this morning on some good news on the jobs front from adp just released. >> and samsung is allowed to sell its galaxy 10.1 tablet computer in the u.s. a judge has lifted a ban on sales of the product after a jury found that it did not illegally use technology developed by apple for its iphones and ipads. but the jury found that many of samsung's other products did fringe on apple patents and ordered the company it pay apple $1 billion. yeah, apple needs that money so bad. >> another billion. >> don't you feel sorry for them? this is kind of strange. i'm reading that there's now a bulletproof case for smartphone? why do we need this? >> reporter: yeah. exactly. i mean, i guess you know you're in a bad neighborhood if you need that. but a japanese company claims its 4.5 pound case can stand up to a gunshot. a .50-caliber bullet was fired at the case. the phone cracked after the gushed sent it tumbling into rocks but the case held unfortunately. but the bulletproof case sells for $665. i don't think it's a big hot seller for the holidays. but i could be wrong. >> you should make it toddler proof.

. you can nail down a samsung for $1300 all in. or you go with -- i've been shopping. for the most part i agree with the picture that bank of america paints with costco. the problem is with the stock. if bank of america is right and they are going to rally 10.5%. that is not enough upside for this guy. the analyst has been wrong. the guy has raised his price from 88 to 94. he tells you not to buy it but he gives a price increase. they think the rally will fizzle though. they know that they have been reinvesting for several quarters. that is something that the former ceo told us. he said we got to take price cuts or keep pricing down to satisfy the customer because the customer is right. bernstein points out that this is something costco has done. that means the company's margins probably won't be as strong as the customer is expecting and this stock could be hammered. the real clincher is what bernstein has to say about valuation. this is what worries me. bernstein points out that costco's stock to remain flat, would have to sell for 20 times earnings. listen to this. the moment that th

from shareholders and regulatory approval. samsung, over apple again, this time over the iphone 5, the latest fight over infringement on the patent. you will remember the korean electronics company sued apple over previous versions for copying certain innovations like synchronizing photos, music, and video files across several devices and methods to capture and send video over the internet. the latest case is due to go to trial in march of 2014. and if you're a fitness geek, you probably heard of trx. all of the rage now. there is a recall announced on trx equipment and involves older model professional and tactical suspension trainer devices made between 2006-2007. a buckle on the devices can break causing users to fall. there have been 700 -- excuse me, 570 reported breaking and at least 13 cases of head, face, shoulder, and hip injuries. trx, by the way, has a workout system leveraging gravity and the body weight for really challenging exercises and that is a favorite among navy seals. those are today's consumer headlines. back to you. >> thank you, laura. >>> turning to weathe

competing against the samsung galaxy note at this point. they're forced into that. so if i were a buyer, i would either buy google or i'd be a buyer of amazon and i would wait to see what happens with apple. i think it can go $50 or $60 lower before you see the run back up. >> brian kelly, the trade of late has been impressive, a dramatic rise. it's outperformed apple. you can see that on the chart. it tells a really good story. are you buying the story? >> certainly if you're buying the stock here, you've missed a good portion of the run. >> if you buy apple here, you've missed the run, too. >> we have something to shoot against. apple you have something to shoot against. you have the 650 level which it seems to be holding against that. you can buy apple here. and we just heard that there is a product cycle here. we have the ipad mini. we potentially have the apple tv coming in next quarter or the next year. and to me i'm not that worried about the margins. it's kind of like a king cut prime rib which bk likes to order and a queen cut which grass owe mig sgchlt grasso might want to order.
